Terms of Use
These Terms of Use are an agreement between you and Rowe Digital Holdings Pty Ltd (ACN 697 515 521) in its capacity as trustee for the Rowe Digital Trust (ABN 13 313 912 737) ("we", "us", "our"), the developer of PencilDrop. They apply to the PencilDrop app and the PencilDrop website (pencildrop.altdevapps.com), including its entry pages, winners' pages and free colouring pages. By creating an account, and each time you enter a competition, you accept these Terms.
1. Minimum age
You must be 16 or older to use PencilDrop. PencilDrop is an adult creative competition and is not designed for children.
We do not ask for your date of birth or age and we do not store it. If we learn that an account holder is under 16, we will suspend the account and, once confirmed, delete it and its personal information within 30 days.
2. Your account
- You can colour without an account. You need an account to enter competitions, keep a streak and see your results on other devices.
- You sign in with Apple, Google or an email link. Keep access to that sign-in method secure; you are responsible for activity on your account.
- One person, one account. Do not create accounts to gain an advantage in judging or competitions.
- Your display name must follow the Community Rules. We may reject or reset a name that does not.
3. Your entries and our licence to show them
You keep ownership of the colouring you create. The line art itself belongs to us or our licensors (see section 4).
When you submit an entry to a competition, you give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, render and display that entry, together with your display name, avatar and chosen country:
- in the app, including judging, results and leaderboards;
- on the PencilDrop website, including its entry pages and winners' pages;
- in promotional material for PencilDrop, including social media and store listings.
Time-lapses. Your entry is recorded as the strokes you made, so we can render a video of it being coloured. The licence above includes rendering and showing such a time-lapse of your entry, with the PencilDrop watermark, wherever the entry itself may be shown.
Placed entries. If your entry places in a competition (for example in the top three of a drop), we may show it, its time-lapse, your display name and your chosen country on the website's winners' pages and in our own social media channels as part of the published results, and keep them there as the record of that competition.
This licence lasts while the entry is on PencilDrop. If you delete an entry or your account, we stop using it in new material and remove it from the website, but promotional material already published does not have to be withdrawn. You confirm that your entry is your own work and follows the Community Rules.
When you share an entry from the app, we create a time-lapse video and a poster image of it and publish them at a public link while the entry is live, so that the people you share with can see it. Shares from a free account carry a small PencilDrop watermark. Where you post a share is your choice and your responsibility.
Work made in free-draw mode is never published by us. If you export and share it yourself, it is your responsibility.
4. Our content
The colouring pages, palettes, brushes and the app itself belong to us or our licensors. Colouring pages are created with the help of AI image generation and are marked as AI-generated in the app, with an explanation one tap away. We give you a personal, non-transferable licence to use them inside PencilDrop and to share exports of your own colouring for personal, non-commercial purposes.
Free colouring pages. Pages we publish on the website as free colouring pages may be downloaded and printed for your own personal, non-commercial use. They may not be sold, redistributed, published elsewhere or used to train or evaluate machine-learning systems.
5. Competitions
Competitions are run under the Competition Rules, which form part of these Terms. Entry is free and no purchase is necessary.
6. Community Rules and enforcement
You must follow the Community Rules, which form part of these Terms. We review entries before and after they are published. If you break the rules we may, depending on how serious it is:
- withhold an entry while it is reviewed;
- warn you;
- remove an entry, and reverse any points, placings or prizes it earned;
- suspend your account for a period;
- permanently ban your account.
You can appeal any enforcement decision from the app or by contacting us (section 13).
7. Ink, prizes and advertising
- Ink is an in-app currency you earn by taking part. It is never sold on its own: the only Ink that comes with a payment is the Ink that PencilDrop Plus includes each month (see section 8). Ink is one balance however you had it, has no cash value and cannot be transferred. Ink you hold stays yours when Plus ends.
- Avatar pages you unlock with Ink, like those that come with Plus, are for your profile picture only: they are never entered in a competition.
- Prizes are digital items only. They have no cash value and cannot be traded, gifted or sold.
- Invites earn Ink for you and the friend you invite once their first entry is live, up to a limit per month shown in the app. Invites never change how anyone is judged or ranked. We may withhold or take back invite Ink where we detect abuse, such as invited accounts that are not real people.
- The app may show advertising, but never while you colour. Personalised advertising is only shown if you consent, and saying no changes nothing else.
8. PencilDrop Plus subscriptions
What Plus includes. PencilDrop Plus is an optional subscription. The subscription screen in the app shows exactly what it includes, and what it does not, before you buy. It currently includes: no advertising (and no advertising software running for you at all); 1,000 Ink for each paid month (250 during a free trial, and the remaining 750 when it becomes paid; an annual plan pays it month by month); a Plus Edition palette, frame or backdrop for each paid month, kept for good; the chisel and watercolour brushes; six more palettes, and saving your own palettes; the Dusk frame, the Gloaming frame after six paid months and the Midnight frame after twelve; a second streak freeze; and 20 draft slots for pages in progress, competition pages included, instead of 5. The amounts are those shown in the app when the month is paid. We may add to Plus. If we remove something it includes, we will tell you in the app first.
No competitive advantage. Plus changes what you can make, never how you are judged. Competition entry, eligibility, judging, rankings and prizes are identical with and without Plus.
Buying and renewal. Plus is sold monthly or yearly through the App Store or Google Play, which take the payment. The price, the billing period and any free trial are shown before you confirm. The subscription renews automatically at the end of each period, at the price then shown, unless you cancel at least 24 hours before the period ends. A free trial becomes a paid subscription when it ends unless you cancel at least 24 hours before then.
Cancelling. You cancel through your App Store or Google Play account settings, not in the app, and deleting the app does not cancel it. When you cancel, Plus stays on until the end of the period you have paid for and then stops. Refunds are handled by Apple or Google under their policies, and nothing in these Terms limits your rights under the Australian Consumer Law.
Restoring. Plus belongs to your PencilDrop account. On a new device, or after reinstalling, sign in to the same account and use Restore purchases on the subscription screen with the same App Store or Google Play account.
When Plus ends. The Plus features stop, and everything you made stays: your drafts, the palettes you saved, and your entries and results. So does what you kept: the Ink you hold, your Plus Edition items, and a second streak freeze you hold until it is spent.
9. Ending your account
You can delete your account in the app at any time. We delete your personal information within 30 days, as described in the Privacy Policy. We may suspend or end your access if you seriously or repeatedly break these Terms.
10. Your consumer rights
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other laws that cannot be excluded. Subject to those rights, the app is provided "as is", and to the extent the law allows we are not liable for indirect or consequential loss, or for loss of data stored only on your device.
11. App stores
These Terms are between you and us, not Apple or Google. Apple and Google are not responsible for the app, its content, maintenance or support, or any claim about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Changes
We may change these Terms. Each time you enter a competition you accept the version of these Terms linked under the button you tap to enter, which shows its date at the top, so please read it before you enter. If you do not accept a new version, do not enter again; you can delete your account at any time (section 9).
13. Law and contact
These Terms are governed by the laws of Australia. Questions, appeals and notices: hello@altdevapps.com.
